RiskD3M is offered by ElasticD3M, LLC to eligible organizations in the United States. By purchasing or using RiskD3M, you certify, on behalf of yourself and the organization you represent, that each of the following is true and will remain true throughout your use of the service.
You are at least 18 years old and are authorized to purchase RiskD3M and to accept our Terms of Use, Acceptable Use Policy, Data Processing Agreement, and this Certification on behalf of the organization you represent.
You and the organization you represent are located in the United States, and you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions or embargo.
Neither you, the organization you represent, nor any person that owns or controls it is: (a) identified on the U.S. Treasury Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List or any other U.S. restricted-, denied-, or debarred-party list; (b) owned 50% or more, individually or in the aggregate, or otherwise controlled by any such party; or (c) otherwise a person with whom U.S. persons are prohibited from transacting.
You will use RiskD3M only for lawful purposes consistent with the Acceptable Use Policy, will not use it on behalf of a prohibited or sanctioned party, and will comply with all applicable U.S. export control and economic sanctions laws. You will not use RiskD3M to facilitate any transaction that those laws prohibit.
You acknowledge that ElasticD3M relies on this Certification to provide the service and to process payment through its payment processor. If any statement here is or becomes untrue, you will stop using RiskD3M and notify us at [email protected], and we may suspend or terminate access and cancel or reverse any transaction, without refund of fees already incurred, and take any action required by law.
