This Acceptable Use Policy governs how you may use RiskD3M, an Agent as a Service offering provided by ElasticD3M, LLC. It supplements our Terms of Use. By using RiskD3M you agree to this Policy on behalf of the organization you represent.
1. Permitted use
You may use RiskD3M only for your organization's own lawful business purposes: to produce cyber financial materiality decision support that your authorized officers, directors, and counsel review before use. You may use the analysis we deliver internally and share it with your own advisors.
2. Prohibited use
You may not, and may not permit anyone else to:
- use RiskD3M for any unlawful purpose, or in violation of any applicable securities, export, sanctions, privacy, or other law;
- present a RiskD3M output as a materiality determination, a legal or accounting opinion, an audit, or a completed regulatory filing, or represent that ElasticD3M has determined materiality or filed anything on your behalf;
- submit facts or data you are not authorized to share, or that contain another party's confidential information without permission;
- rely on RiskD3M as a substitute for professional legal, accounting, actuarial, audit, or investment advice, or without independent officer and counsel review;
- resell, sublicense, or provide RiskD3M or its outputs to third parties as a service, or use them to build a competing product or model;
- reverse engineer, scrape, or attempt to extract the underlying models, methodology, or software, or circumvent any usage, rate, or cost limit;
- probe, scan, or attempt to breach the security or integrity of the service, or introduce malware or interfere with its operation;
- use RiskD3M to harass, defraud, or mislead any person, or to generate false or misleading disclosures.
3. Eligibility and jurisdiction
RiskD3M is offered to organizations in the United States and processes data in the United States. You confirm you are eligible to purchase and use it under our Purchaser Eligibility and Prohibited-Entity Certification.
4. Enforcement
We may investigate suspected violations and may suspend or terminate access for conduct that violates this Policy or that we reasonably believe is unlawful or harmful, with or without notice where the circumstances warrant. Suspension for cause does not entitle you to a refund of fees already incurred; see our Refund Policy.
